Submission to the Department of Justice and Constitutional Development on SA’s Third Country Report under the International Convention Against Torture

LHR submitted this report in response to the call for input on the draft of South Africa’s third periodic country report under the International Convention Against Torture and other cruel, inhuman or degrading treatment or punishment. The draft report was shared on 23 February 2023 with a consultative workshop on 2 March 2023. LHR highlights shortcomings and omissions relating to the following topics relevant to South Africa’s international obligations:

  • safeguards for persons deprived of liberty especially vulnerable to torture or other cruel, inhuman or degrading treatment;
  • use of force amounting to torture by correctional services officers and police officers;
  • unlawful practices and conditions of immigration-related arrest and detention;
  • refoulement of migrants who may be in danger of being subjected to torture; and
  • xenophobic violence against non-citizens.
